Agreement
These terms govern your use of the website published by Ekkayi Atelier LLP ("the studio", "we"). By using the website you accept them. If you do not, please do not use it. They are governed by the laws of India, including the Indian Contract Act, 1872 and the Information Technology Act, 2000.
What the website is for
The website presents the studio's work, sells its objects online, and invites enquiries about its signature pieces. Buying an object through the website's bag and checkout is governed by the Terms of Sale, together with the Shipping and the Returns & Refunds policies; where they differ from these terms, they prevail for that purchase.
The signature pieces and limited editions are not sold through the website. For them, submitting an enquiry, or contacting us on WhatsApp, opens a conversation; it does not place an order or reserve a piece. Such an acquisition comes into existence only when the studio confirms it to you in writing, with its price, specification, lead time and payment terms, and those written terms then govern it.
About the pieces as shown
- The images on the website do not represent the finished product. Many of them are digital renders, and some were generated with artificial-intelligence tools from the studio's designs; they are there to present the design and to make the website look its best, not to show the exact piece you would receive. Photographs of the actual pieces are available on request: ask us and we will send them before you commit to anything.
- Every piece is made by hand. The piece you receive will differ from any image of it, in grain, colour, texture, finish and detail. That is the nature of the work, not a defect.
- Dimensions are nominal and may vary slightly. If a measurement matters to you, ask us before you commit.
- Limited editions are made in a fixed number and are available until the last is sold. The number shown on a piece's page is kept up to date by the studio by hand, and is confirmed when you enquire.
- Materials, finishes and specifications may change between the website being updated and a piece being made. The written confirmation is the authority.
Using the website
You may browse the website, share links to its pages, and use the enquiry form and contact details for genuine enquiries. You may not:
- Copy, download, scrape or republish its content, in whole or in part, except as the Copyright page allows.
- Use automated tools to collect information from it or to submit forms.
- Submit anything false, defamatory, unlawful or that infringes anyone's rights.
- Attempt to interfere with the website's operation or security, or to gain access to any part of it you are not meant to see.
What you send us
You are responsible for what you submit and confirm that you are entitled to submit it. By sending us an enquiry you allow us to keep it and to use it to respond to you and to carry out any work that follows, as the Privacy Policy describes. We will not publish anything you send us without your written agreement.
Links to other services
The website links to Instagram, Google Maps and WhatsApp. Those services are not ours; their terms and privacy policies apply once you are there, and we are not responsible for them. A WhatsApp conversation with the studio is a conversation on WhatsApp, subject to its terms as well as to ours.
Availability of the website
We aim to keep the website available and accurate but do not promise that it will be uninterrupted, error-free or free of anything harmful, and we may change, suspend or withdraw any part of it without notice.
Liability
The website and its content are provided as they are. To the extent the law allows, the studio excludes all warranties about the website and accepts no liability for any loss arising from your use of it or your reliance on anything in it. Nothing in these terms limits liability that cannot lawfully be limited, and nothing in them affects the terms agreed in writing for a piece or your rights under the Consumer Protection Act, 2019 in respect of one.
Governing law and disputes
These terms and any dispute about the website are governed by the laws of India. The courts at Ahmedabad, Gujarat have exclusive jurisdiction, subject to any right you have under Indian consumer law to bring a claim elsewhere. Before either side goes to court, we ask that you write to us and give us thirty days to put things right.
Changes to these terms
We may update these terms; the date at the top of the page shows the current version. Continued use of the website after a change is acceptance of it. A change does not affect a piece already confirmed in writing.
